Hollywood star Jamie Foxx has been accused of sexual assault.

It is said to have occurred while at a New York rooftop bar eight years ago.

The lawsuit alleges in the summer of 2015, White House Down actor Foxx, 55, made comments such as ‘Wow, you have that super model body’ while at Catch NYC and rooftop, before later grabbing the woman by the arm and pulling her to the ‘secluded’ back of the rooftop.

It is here where it is alleged there was ‘heinous touching and sexual assault’ which has resulted in ‘severe emotional distress and anxiety’ as well as post-traumatic stress disorder for the woman.

The lawsuit, filed at the New York Supreme Court, alleges that Oscar-winner Foxx – real name Eric Bishop – was ‘operating through his position as a well-known celebrity’.

The woman, identified only as Jane Doe in court documents, is also suing Catch NYC and rooftop and it’s owner Mark Birnbaum, alleging they were ‘negligent’ and ‘failed to use reasonable care to prevent the acts described’ in the lawsuit.

It comes as the New York Adult Survivors Act is set to expire on Thursday, a law passed last year which allows a temporary window for those who allege sexual assault to file past the state’s normal deadlines.

Earlier this year, the Oscar-winning actor revealed he suffered a medical emergency, and spent several weeks in hospital due to a mystery illness.

He later explained how he could have died if it weren’t for the fast actions of his sister who saved him, before telling fans:  ‘You’re lookin at a man who is thankful… finally startin to feel like myself… it’s been an unexpected dark journey… but I can see the light.’ 

Upon his return to social media in July, the actor was forced to shut down the conspiracy theories about his mystery illness, including that he had been cloned during his time away from the public eye. 

However, it’s not been an entirely smooth return as Jamie recently faced accusations of antisemitism after an Instagram post he shared about ‘fake friends’ and ‘fake love’, writing: ‘They killed this dude name Jesus… what do you think they’ll do to you?’ 

He later apologised while Friends actress Jennifer Aniston was dragged into the controversy when she reportedly ‘liked’ the post, which has since been deleted.
